This portion of the meeting is reserved for persons wishing to address the Commission on any matter not on the Agenda that is within the subject matter jurisdiction of the Commission. State law prohibits the Commission from acting on items not listed on the Agenda except by special action of the Commission under specified circumstances. Speakers’ time is limited to three minutes. Additionally, the public may address the Commission on any subject listed on the Agenda.

PUBLIC HEARING
 
A.
Consideration for a Tree Protection Zone Exception (PTPZ24-00006) for a carport at 251 Selby Lane (APN 059-281-250) an approximately 54,880 square foot site within the R1-A zoning district and developed as a single-family dwelling. The PTPZ requests Planning Commission consideration for a driveway and carport that are 3.5x-6x from one (1) Coast Redwood. This proposal has been determined to be categorically exempt from further environmental review pursuant to AMC Section 15.32.100 and CEQA Section 15304 (Minor Alterations to Land) and 15311 (Accessory Structures).
 
B.
Consideration for a Tree Protection Zone Exception (PTPZ24-00008) for a pool, retaining wall, and hardscape at 9 Knoll Vista (APN 073-213-120) an approximately 47,901 square foot site within the R1-A zoning district and developed as a single-family dwelling. The PTPZ requests Planning Commission consideration for a pool, retaining wall, and hardscape that are 3x-5x from four (4) Coast Redwoods. This proposal has been determined to be categorically exempt from further environmental review pursuant to AMC Section 15.32.100 and CEQA Section 15304 (Minor Alterations to Land) and 15311 (Accessory Structures).
 
C.
Consideration for a Tree Protection Zone Exception (PTPZ24-00007) for a garage at 64 Winchester (APN 070-230-060) an approximately 22,414 square foot site within the R1-B zoning district and developed as a single-family dwelling. The PTPZ requests Planning Commission consideration for a driveway and garage that is 3.3x-6x from one (1) Coast Redwood and one (1) Coast Live Oak. This proposal has been determined to be categorically exempt from further environmental review pursuant to AMC Section 15.32.100 and CEQA Section 15304 (Minor Alterations to Land) and 15311 (Accessory Structures).

Planning Commission decisions are appealable by any aggrieved person to the City Council within 10 days of the date of the decision.

If you challenge a Town zoning, planning, or any other decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the Town at, or prior to, the public hearing.  Judicial review of any Town administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final.  Judicial review of environmental determinations may be subject to a shorter time period.

Copies of all staff reports and documents subject to disclosure that relate to each item of business referred to on the agenda are available for public inspection by 5:00 p.m. the Friday before each regularly scheduled City Council meeting.

Public Comments:
The Town of Atherton Council and Committee or Commission meetings are a limited public forum, and all public comment must relate to something that is within the subject matter jurisdiction of the Council or Committees. If comments do not relate to the subject matter jurisdiction of the Council or Committee, we will stop the comment and a warning may be provided. If the comment continues to be outside of the subject matter jurisdiction the speaker will be stopped, and we will move on to the next speaker. Speakers found in violation of this rule of procedure may be removed from the meeting.
