Continued from 12.14.2022 –  2022 Master Plan Annual Update by Menlo College – Private schools in Atherton have a Master Plan which is updated annually and reviewed by the Planning Commission at a noticed meeting.  The 2022 Master Plan Update has been submitted by Menlo College at 1000 El Camino Real, Atherton, CA (Assessor’s Parcel Number 070-360-100). 

CEQA: The proposal has been determined to be exempt from the provisions of the California Environmental Quality Act (CEQA) Section 15301 Existing Facilities

Staff recommendation: Staff recommends that the Planning Commission conduct the public hearing and approve the Master Plan Annual Update for Menlo College.

Continued from December 14, 2022 hearing –  Tree Protection Zone exception request at 82 Linda Vista, Atherton, CA (Assessor’s Parcel Number 070-161-160) for a proposed ADU. Heritage tree protection Zone Exception for a 7.48x TPZ for a 48” diameter redwood tree and a 6.22x TPZ exception for a 18” coast redwood tree. 
 
CEQA: The proposal has been determined to be exempt from the provisions of the California Environmental Quality Act (CEQA) Section 15304, Minor Alterations to Land. 

Recommendation: Staff recommends that the Planning Commission approved the TPZ exception of two redwood heritage trees  at 7.48x TPZ for tree #2 and 6.22x TPZ for tree #4  as conditioned in the staff report.

Tree Protection Zone Exception at 140 Atherton Ave. Tree Protection Zone exception request for a proposed addition project for tree #190, 42-inch redwood tree to be at 7x and tree #192, 49-inch redwood tree to be at 6x.

CEQA: The proposal has been determined to be exempt from the provisions of the California Environmental Quality Act (CEQA) to CEQA Section 15304, Minor Alterations to Land. 

Recommendation: Staff recommends that the Planning Commission approve an Exception to a Tree Protection Zone (TPZ) one 42” redwood (Tree #190) to seven times (7.0x) and deny an exception to a TPZ for one 49” redwood tree (Tree #192) to six times (6.0x) the trees diameter at 140 Atherton Ave in Atherton based on the following finding and for the reasons outlined in this report.

 ADU Ordinance Amendments: Consideration of a recommendation to the Town Council to approve amendments to Atherton Municipal Code Chapters 17.52 Accessory Dwelling Units, Chapter 17.60 Definitions, and Chapter 17.36 Public Facilities and Schools District (PFS).

CEQA; The proposal has been determined to be exempt from the provisions of the California Environmental Quality Act (CEQA) to CEQA Section 15305, Minor Alterations in Land Use Limitations.

Recommendation: Staff recommends that the Planning Commission conduct the public hearing and recommend that the City Council approve amendments to Atherton Municipal Code Chapters 17.52 “Accessory Dwelling Units”, Chapter 17.60 “Definitions” and Chapter 17.36 Public Facilities and Schools District (PFS) based on the following finding and for the reasons outlined in the staff report.

If you challenge a Town zoning, planning, or any other decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing.  Judicial review of any Town administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final.  Judicial review of environmental determinations may be subject to a shorter time period.
Copies of all staff reports and documents subject to disclosure that relate to each item of business referred to on the agenda are available for public inspection by 5:00 p.m. the Friday before each regularly scheduled Planning Commission meeting at the Atherton Library, 2 Dinklespiel, Station Lane, and the Town Administrative Offices, 80 Fair Oaks Lane, Atherton, CA 94027.
In compliance with SB 343, materials related to an item on this Agenda submitted to the Planning Commission after distribution of the agenda packet are available for public inspection in the Town Administrative Offices, 80 Fair Oaks Lane, during normal business hours.
Planning Commission decisions are appealable by any aggrieved person to the City Council within 10 days of the date of the decision.
